Closure of Criminal Proceedings and Recovery of Seized Assets | Ukraine
Client —an individual entrepreneur operating in the consultancy, marketing, andaffiliate services sector, including the organisation and management of internationalaffiliate marketing programmes, customer acquisition, advertising campaignmanagement, and digital marketing advisory services.
Matter— comprehensive defence of the client in criminal proceedings. During thepre-trial investigation, law enforcement authorities conducted searches of theclient's office premises, residences, and vehicles, as well as a number ofother investigative and procedural measures. A key objective of the defence wasto prevent unjustified criminal prosecution, preserve the client's assets, andchallenge the erroneous criminal-law characterisation of the client's lawfulbusiness activities.
Role —  a BLACK FORT partner developed andimplemented a comprehensive defence strategy aimed at challenging theprosecution's case, securing the termination of the criminal proceedings,protecting the client's lawful business activities, and recovering the seizedassets.
Outcome— the criminal proceedings against the client were closed. The BLACK FORT teamsecured the termination of the criminal prosecution, prevented the unjustifiedseizure of USD 200,000 during the searches, obtained therelease of asset freezes, secured the return of the seized property, includinga motor vehicle, and fully restored the client's right to possess, use, anddispose of the relevant assets.
Status— the criminal proceedings have been closed. The asset freezes have beenlifted, and the property has been returned to the client.
Significance of the Matter —the matter combined the need to protect the client against unjustified criminalprosecution while simultaneously restoring property rights that had beensignificantly restricted as a result of extensive investigative measures.
Aparticular challenge was demonstrating that the client's activities in theinternational affiliate marketing and advertising sectors constituted lawfulentrepreneurial activity carried out under civil and commercial agreements anddid not contain the elements of a criminal offence.
The defence strategy wasaimed not only at securing the termination of the criminal proceedings, butalso at preserving the continuity of the client's business operations,protecting the client's business reputation, and ensuring the effectiverestoration of the client's property rights.
